Union Tiles Colossal Shopper Promotional Competition

  1. This Promotional Competition (“Competition”) is organised by Union Tiles (Pty) Ltd, a company incorporated in the Republic of South Africa, and its agency (“the Promoter”).
  1. The competition is open to participants who are permanent residents and citizens of South Africa, over the age of 18 years, in possession of a valid South African Identity Document. Any person who is under the age of 18 years must obtain express consent from their parent / legal guardian in order to enter and qualify as a participant for the Competition (together referred to as “Participants/Entrants”).
  1. Any employee, director, member, partner, agent or consultant of or any person, directly or indirectly, who controls or is controlled by the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person, indirectly or directly, in control or controlled by the Promoter, its advertising agencies, advisers, dealers, suppliers of Union Tiles (Pty) Ltd is not able to enter this competition (“Disqualified Participants”).
  1. Corporate clients or entities are not eligible to enter this competition (“Disqualified Participants”). A corporate client is defined as an individual or firm involved in a corporate project in which product has been specified or selected via a tender process.
  1. No person may on behalf of a third party, enter the competition. All entries must be made personally by the entrant.
  1. The Competition is only valid within South Africa. Participants must be within South Africa at the time of entering the Competition, for the verification process and at the time of the prizes being awarded should they be declared a winner, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.
  1. By entering the Competition, all Participants and Winners, including a parent or legal guardian of a Minor Participant, agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding and no correspondence shall be entered into regarding the decision. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.
  1. The competition commences 8 October 2018 and ends on 16 November 2018, both days inclusive (the “Duration”).
  1. Participants purchasing products from Union Tiles South African stores during the Duration of the Competition stand a chance to win one of the following prizes
  • Participants who spend to the value of R40,000 including VAT or more, excluding delivery charges, stand a chance of winning: 1 (one) fly and cruise Mediterranean trip (“Trip Prize”), for you and 1 (one) travel partner (“Travel Partner”). The Trip Prize includes return flights ex OR Tambo International Airport Gauteng, plus 1 night accommodation before the cruise in a standard room, plus a 7 nights cruise on board the MSC Bellissima visiting Genoa, Naples, Messina, Malta, Barcelona and Marseille with all meals and selected drinks while on board.
  • Participants who spend to the value of R5,000 including VAT or more, excluding delivery charges, stand a chance of winning: 1 (one) of our daily cash prizes (“Daily Cash Prize”) of R500 on a pre-loaded MasterCard gift card.
  1. The Trip Prize Winner and their Travel Partner must be available to travel together to Europe between the 5th and 12th May 2019 (“Travel Dates”). Should the Winner be unavailable to take up the Trip Prize on the Travel Dates, provided and determined by Promoters, the Winner and their 1 (one) Travel Partner will be deemed to have forfeited the Trip Prize. In such event the Trip Prize will revert back to the Promoter.
  1. The Trip Prize Winner and their Travel Partner must be in possession of a valid passport and is responsible for their own visa’s, travel insurance, spending, meals and drinks not included, port excursions and additional activities.
  1. Should the Trip Prize Winner be a Union Tiles account holder, qualifying purchases made during the Duration of the Competition must be settled in full within 30 days of invoice date to remain eligible.
  1. Participants who return products purchased could be disqualified if the final sale value after the return is below the minimum spend criteria as defined in section 9. Returns are strictly subject to the current Union Tiles returns and refunds policy.
  1. Daily Cash Prizes will be determined by random selection and awarded daily in arrears based on previous day’s qualifying purchases and entry forms. Winners will be contacted telephonically, required to collect their prize personally in-store having their photo taken and published on the Company’s Social Media pages.
  1. Trip Prize Winner will be determined by random selection of all qualifying purchases and corresponding entry forms received from all participating Union Tiles South African stores. The draw will take place at Union Tiles Bedfordview on Wednesday 28th November 2018 in the presence of independent auditors and streamed live on the Company’s Facebook page.
  1. The Company’s decision is final and no correspondence will be entered into.
  1. Prizes are not transferable and no substitutions or cash equivalents are permitted. Winners will be notified by telephone and email. The winner will have 7 days from receipt of the prize notification to claim their prize by responding on email. If the winner does not claim their prize within this period, the Promoter will be entitled to select an alternative Trip Prize Winner.
  1. The prize must be taken and travel completed as per the dates of the prize. Dates will be set and communicated upon notification.
  1. The participants entering or taking part in the competition agree that they have read, understand and accepted the following consent to process personal information in terms of the Protection of Personal Information Act, 4 of 2013 by Union Tiles (Pty) Ltd and will abide by these terms and a participant’s entry into the competition acknowledges its formal acceptance of these terms.
CONSENT TO PROCESS PERSONAL INFORMATION IN TERMS OF THE PROTECTION OF PERSONAL INFORMATION ACT, 4 OF 2013 (POPI) BY UNION TILES PROPRIETARY LIMITED (REGISTRATION NUMBER 1996/014733/07)
INTRODUCTION
The Protection of Personal Information Act, 4 of 2013, (POPI) regulates and controls the collection, use, transfer and processing of an individual or legal entity’s Personal Information
In terms of POPI, a “Responsible Party” (in this case being Union Tiles (Pty) Ltd) has a legal duty to process a Data Subject’s Personal Information (in this case being your “Personal Information”) in a lawful, legitimate and responsible manner.
The company and their employees do from time to time process Personal Information.
In terms of POPI all persons, including any employee  who collects, manages, processes, transfers, stores and / or retains Personal Information, whether held under a document, record or in any other format has  a responsibility to process such information in accordance with the provisions housed under POPI.
In order to discharge this duty, the Group of Companies require your express and informed permission to process your Personal Information.
DEFINITIONS
“Personal information” means any information of a personal nature belonging to a Data Subject which may be or which is processed, collected, and used by a Responsible Party, and which will include any information related to or owned by either a private or public entity and/or natural individual such as a name, address and ID number, educational, medical, criminal or employment history, as well as information pertaining to financial transactions, views or opinions and information relating to the race, gender, sex, pregnancy, marital status, nationality, ethnic or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person.
“Processing” means the collecting, receiving, storing, using (including sharing of Personal Information with credit bureaus), updating, modifying, disseminating and destruction of Personal Information.
“Responsible Party” means the person, legal entity, company or public body that is responsible for processing an entity or individual’s personal information.
“Data Subject” means the individual, legal entity, public body or company, whose personal information is being processed.
PURPOSE FOR THE COLLECTION
The purpose for the collection of your Personal Information and the reason why the company requires your Personal Information is to enable the company to:
  1. comply with lawful obligations, including all applicable labour, tax and financial legislation (including compliance with any South African Reserve Bank and Johannesburg Stock Exchange requirements) such as the Financial Advisory And Intermediary Services Act, 37 of 2002 (FAIS), the Financial Intelligence Centre Act 38 of 2001 (FICA), the National Credit Act, 34 of 2005 (NCA) and B-BBEE laws;
  2. to give effect to a contractual relationship as between you and the company and in order to ensure the correct administration of the relationship;
  3. for operational and marketing reasons; and
  4. to protect the legitimate interests of the company, yourself or a third party.
All Personal Information which you provide to the Group of Companies will only be used for the purposes for which it is collected.

General Conditions of Sale

  1. Installation of the goods purchased implies acceptance of their condition.
  2. Purchaser shall ensure that colour, shades, size and quality are acceptable before affixing the tiles or cutting the slabs.   UNION TILES shall not entertain any claims whatsoever for tiles/slabs which have already been affixed/cut.
  1. No claims will be considered on 2nd grade goods purchased or goods purchased as “specials” or at a Clearance Sale. Such goods shall be deemed to have been purchased voetstoots.

Specially Ordered Goods

  1. Specially Ordered Goods will not be accepted back for credit or a cash refund including goods sold voetstoots.
  2. UNION TILES shall at its sole discretion be entitled to take possession of any goods which have been returned for credit, in which event the purchaser shall be entitled to a credit in respect of the goods so returned at the price at which they were sold or the value thereof as determined by us, and subject to 10% or such handling fees as may be applicable.
  3. We reserve the right not to accept goods returned for credit. Goods returned for credit must be returned within 30 days of purchase and accompanied with the original invoice. unless they are accompanied by the original purchase slip, cashier signed & stamped.
  4. No credit will be allowed on goods made or ordered specially to purchasers requirements. These include but are not limited to, non-stock items and Random Polished Slabs once they have been cut.

Transportation of Goods Purchased

  1. We accept no responsibility whatsoever for any damage caused if required to load or offload on private property.
  2. Cartage is chargeable on all deliveries we are required to undertake from time to time at purchasers request.
  3. Orders are accepted by UNION TILES subject to stock availability and we accept no liability in respect of any delays in delivery of the goods ordered. We reserve the right to deliver goods in two or more installments and further reserve the right to withhold supplies in the event of any breach of any of these terms and conditions for any reason which we consider warrants such actions.
  4. Delivery shall be completed when the goods are off-loaded at its destination by UNION TILES or when the goods are loaded by the purchaser, alternatively a courier engaged to transport the goods to and/or on behalf of the purchaser.
    • Notwithstanding the aforesaid of any term in this agreement, delivery shall be deemed completed against signature of UNION TILES’S delivery note by the purchaser or any representative of the purchaser.
    • In the event that a courier is engaged on behalf of the purchaser, it is accepted and agreed that the courier acted as agent for the purchaser.
    • UNION TILES shall not be liable under any circumstances for any complaint or claim for any alleged shortage in delivery or defect in the goods unless written notice is received by us within 48 hours after delivery of the goods to the purchaser.

Ownership and Risk

All goods supplied by UNION TILES to the purchaser shall remain the property of UNION TILES until the purchase price in respect thereof has been paid in full, but the purchaser shall have the right to dispose thereof in the ordinary course of normal business, in which event it is hereby expressly agreed in advance that the claim to any right of the recovery of the purchase price from the eventual purchaser of the goods, shall be ceded to UNION TILES as security for payment of any amount outstanding.

  1. The risk in the goods shall pass to the purchaser on delivery of the goods notwithstanding that ownership will not pass to the purchaser until full payment of the purchase price.

Payment

  1. Customers having a credit facility with UNION TILES are to make payment within 30 (thirty) days of date of statement unless otherwise agreed in writing. Such payments shall constitute payment to UNION TILES.
  2. The price of goods sold to the purchaser is strictly net and not subject to any discounts unless otherwise agreed to in writing. In the event that a discount is agreed to in writing it shall only be allowed if payment is received by UNION TILES strictly by the due date and shall only apply to the actual price of the goods themselves and not to any value added tax, transport costs, insurance storage charges or other duties or taxes.
  3. All payments are to be made without deduction of any kind and will be free of exchange, bank costs and other charges and will be paid at the address reflected on the face hereof, or such other address as UNION TILES may elect from time to time in writing.
  4. The purchaser will be responsible for all Attorney’s fees together with collection charges, should legal action be required in order to recover any monies due.
  5. If at any time payment is not made on due date, or if the purchaser’s credit limit with UNION TILES has been exceeded then, without prejudice to any other legal remedy which we may have in law, UNION TILES may:

17.1  Charge interest on the amount due at the bank prime rate, which shall mean the prime overdraft rate charged by our bankers to members of the private sector on unsecured overdraft    facilities;

17.2  and/or without prior notice, defer further deliveries or performance in terms of this agreement until payment is made;

17.3  and/or upon written notice forthwith cancel the remainder of the agreement and recover from the purchaser all the monies then due or owing by the purchaser for goods already delivered and payment for such damages as UNION TILES may have sustained.

Natural Stone Products

  • Use of a mild neutral detergent (S.Q.T. Natural Stone Detergent) followed by a clean water rinse may be necessary in excessively dirty areas.
  • Do not use scouring powder or abrasive cleaning materials, acidic or alkaline detergents or corrosive liquids.
  • Buffing the surface with a soft dry cloth will remove traces left by drying water.
  • Please consult us for detailed information on methods of removing stubborn stains, as well as on the application of surface sealers.

 UNION Terrazzo Tiles

  • Cement and Terrazzo floor tiles should always be stored indoors or undercover. If stored outdoors, crazing may result.
  • Please consult us for information on factory pre-sealing of Terrazzo tiles, which is available at a nominal fee per square meter.

 All Types of Tiling, including Ceramic and Porcelain Tiling

  • Tile thickness variations are inherent in Terrazzo Tiles and is corrected by laying in a screed bed. The screed bed must consist of Ceramic Tile Adhesive.
  • Slight variations in size of Terrazzo Tiles is corrected by laying the tiles with a 4-10mm joint and grouting later.
  • Do not use Hydrochloric Acid based cleaning chemicals (Spirits of Salts) to clean Terrazzo or Natural Stone Tiles as this is too harsh and corrosive.
  • Use only Ceramic Tile Adhesive for Terrazzo Tiles.
  • NO Porcelain Adhesives to be used for Terra-Stone or Terrazzo Tiles.
  • Ensure shades and calibrations are the same and acceptable prior to laying.
  • Allow suitable expansion joints between the tiles.
  • Provide for structural movement joints in larger areas.
  • Use the correct adhesive for the tile type and the application area.
